The court of the Austrian district of Hermagor ruled that buying and opening loot boxes in FIFA 23 is gambling.

The consideration of the case was the reason for the expenditure of 340 euros by one of the local football fans. The website Games Wirtschaft drew attention to this.

A fan of a series of sports simulators wanted to return the money paid and filed a lawsuit against Sony Interactive Entertainment Network Europe Limited.

It is important to note that the victim decided to ask the console manufacturer, and not the game publisher, which is Electronic Arts.

The fact is that Sony is directly the recipient of funds, since it is it that processes payments for loot boxes.

As a result, the court sided with the player, noting that he did not receive the content for the amount spent, and the platform holder does not have a license to conduct gambling.

While the decision has not entered into legal force, Sony will have the opportunity to appeal.
